Torture and the Law of Proof: Europe and England in the Ancien Régime
By John H. Langbein. 2006
In "Torture and the Law of Proof" John H. Langbein explores the world of the thumbscrew and the rack, engines…
of torture authorized for investigating crime in European legal systems from medieval times until well into the eighteenth century. Drawing on juristic literature and legal records, Langbein's book, first published in 1977, remains the definitive account of how European legal systems became dependent on the use of torture in their routine criminal procedures, and how they eventually worked themselves free of it. The book has recently taken on an eerie relevance as a consequence of controversial American and British interrogation practices in the Iraq and Afghanistan wars. In a new introduction, Langbein contrasts the "new" law of torture with the older European law and offers some pointed lessons about the difficulty of reconciling coercion with accurate investigation. Embellished with fascinating illustrations of torture devices taken from an eighteenth-century criminal code, this crisply written account will engage all those interested in torture's remarkable grip on European legal history.Land Use and Society: Geography, Law, and Public Policy
By Rutherford H. Platt. 2014
The intersection between geography and law is a critical yet often overlooked element of land-use decisions, with a widespread impact…
on how societies use the land, water, and biodiversity around them. Land Use and Society, Third Edition is a clear and compelling guide to the role of law in shaping patterns of land use and environmental management. Originally published in 1996 and revised in 2004, this third edition has been updated with data from the 2010 U. S. Census and revised with the input of academics and professors to address the changing issues in land use, policy, and law today. Land Use and Society, Third Edition retains the historical approach of the original text while providing a more concise and topical survey of the evolution of urban land use regulation, from Europe in the Middle Ages through the present day United States. Rutherford Platt examines the "nuts and bolts" of land use decision-making in the present day and analyzes key players, including private landowners, local and national governments, and the courts. This third edition is enhanced by a discussion of the current trends and issues in land use, from urban renewal and demographic shifts in cities to the growing influence of local governance in land use management. Land Use and Society, Third Edition is a vital resource for any student seeking to understand the intersection between law, politics, and the natural world. While Platt examines specific rules, doctrines, and practices from an American context, an understanding of the role of law in shaping land use decisions will prove vital for students, policymakers, and land use managers around the world.King of the Empty Plain

By Jason Ripper. 2008
This book is ideal for any introductory American history instructor who wants to make the subject more appealing. It's designed…
to supplement a main text, and focuses on "personalized history" presented through engaging biographies of famous and less-well-known figures from the colonial period to 1877. By Corinna Morandi, Andrea Rolando, Stefano Di Vita. 2016
This book offers a fascinating exploration of the relationship between information and communication technologies (ICTs) and spatial planning, expanding the…
concept of "urban smartness" from the usual scale of buildings or urban projects to the regional dimension. In particular, it presents the outcomes of research undertaken at Politecnico di Milano, in collaboration with Telecom Italia, that had three principal goals: to investigate the use of ICTs for the representation, promotion, management, and dissemination of an integrated system of services; to explore the spatial impacts of digital services at different scales (regional, urban, local); and to understand how a system of mobile services can encourage new spatial uses and new collective behavior in the quest for better spatial quality of places. Useful critical analysis of international case studies is also included with the aim of verifying the opportunities afforded by new digital services not only to improve the urban efficiency but also to foster the evolution of urban communities through enhancement of the public realm. The book will be a source of valuable insights for both scholars and local administrators and operators involved in smart city projects.William and Caroline Herschel
By Michael Hoskin. 2014
This beautifully structured book presents the essentials of William and Caroline Herschel's pioneering achievements in late 18th-century astronomy. Michael Hoskin…
shows that William Herschel was the first observational cosmologist and one of the first observers to attack the sidereal universe beyond the solar system: Herschel built instruments far better than any being used at the royal observatory. Aided by his sister Caroline, he commenced a great systematic survey that led to his discovery of Uranus in 1781. Unlike observers before him, whose telescopes did not reveal them as astronomical objects, Herschel did not ignore misty patches of light. Hoskins points out Herschel's achievement in surveying, cataloguing, and describing them as "nebulae" and even coming to the correct conclusion that their structure evolved over time, with Newton's gravity being the agent of change. Herschel's surveys established a new astronomy - looking at the universe rather than the planets! Michael Hoskin's account includes sketches and diagrams from Herschel's manuscripts in the Royal Astronomical Society Archives in which he attempts to delineate the structure of the Milky Way galaxy. While it is well-known that Herschel was a revolutionary in telescope design who constructed the world's largest telescopes, Hoskin also gives the full picture of the man as an entrepreneur who built and traded some 400 telescopes. Hoskin also pays close attention to the role of William's sister Caroline Herschel, who is usually portrayed as a "helpmate" to her brother. But in fact she became a significant astronomer in her own right. This book also offers a wealth of information of the wider Herschel family. It is enriched by a complete set of portraits of William and Caroline Herschel with an extensive set of images of their residences and closes with a charming appendix on how visitors to the Herschels recorded their encounters. William and Caroline Herschel - Pioneers in Late 18th-Century Astronomy will appeal to amateur astronomers and all those interested in popular astronomy. This book will rapidly establish itself as the primary introductory work for students, astronomers, and scholars working on the history of natural science in the late 18th century.Marginality: Addressing the Nexus of Poverty, Exclusion and Ecology
By Joachim Von Braun, Franz Gatzweiler. 2014
This book takes a new approach on understanding causes of extreme poverty and promising actions to address it. Its focus…
is on marginality being a root cause of poverty and deprivation. "Marginality" is the position of people on the edge, preventing their access to resources, freedom of choices, and the development of capabilities. The book is research based with original empirical analyses at local, national, and local scales; book contributors are leaders in their fields and have backgrounds in different disciplines. An important message of the book is that economic and ecological approaches and institutional innovations need to be integrated to overcome marginality. The book will be a valuable source for development scholars and students, actors that design public policies, and for social innovators in the private sector and non-governmental organizations.Electronic Technology and Civil Procedure
By Zoltán Nemessányi, Miklós Kengyel. 2011
The effect of modern and communication technology on civil procedure first appeared on the agenda of the conference organized by…
the International Association of Procedural Law in 1999, verifying Lord Woolf's statement from the 90's, that "IT will not only assist in streamlining and improving our existing systems and process; it is also likely, in due course, itself to be catalyst for radical change as well...". At the conference in Pecs in the autumn of 2010 participants from three continents and twenty-five countries examined all aspects of the impact of modern information technology on civil procedure beginning with the electronic submission of the application, ranging from electronic service of documents and electronic means of proof supported by modern information technology. In addition to the practical issues they discussed the possible impact of electronic procedures on traditional principles of civil procedure. The conference book contains seven main reports and eleven correferates, the foreword was written by Prof. Peter Gottwald, the President of the International Association of Procedural Law.The Falling Sky: Words of a Yanomami Shaman
By Alison Dundy, Davi Kopenawa, Bruce Albert, translated by Nicholas Elliott. 2013
"The Falling Sky" is a remarkable first-person account of the life story and cosmo-ecological thought of Davi Kopenawa, shaman and…
spokesman for the Yanomami of the Brazilian Amazon. Representing a people whose very existence is in jeopardy, Davi Kopenawa paints an unforgettable picture of Yanomami culture, past and present, in the heart of the rainforest--a world where ancient indigenous knowledge and shamanic traditions cope with the global geopolitics of an insatiable natural resources extraction industry. In richly evocative language, Kopenawa recounts his initiation and experience as a shaman, as well as his first encounters with outsiders: government officials, missionaries, road workers, cattle ranchers, and gold prospectors. He vividly describes the ensuing cultural repression, environmental devastation, and deaths resulting from epidemics and violence. To counter these threats, Davi Kopenawa became a global ambassador for his endangered people. "The Falling Sky" follows him from his native village in the Northern Amazon to Brazilian cities and finally on transatlantic flights bound for European and American capitals. These travels constitute a shamanic critique of Western industrial society, whose endless material greed, mass violence, and ecological blindness contrast sharply with Yanomami cultural values. Bruce Albert, a close friend since the 1970s, superbly captures Kopenawas intense, poetic voice. This collaborative work provides a unique reading experience that is at the same time a coming-of-age story, a historical account, and a shamanic philosophy, but most of all an impassioned plea to respect native rights and preserve the Amazon rainforest.Casanova the Irresistible
By Armine Kotin Mortimer, Phillippe Sollers. 2016
His is a name synonymous with seduction. His was a life lived without limits. Giacomo Casanova left behind thousands of…
pages detailing his years among Europe's notable and noble. In Casanova the Irresistible, Philippe Sollers--prolific intellectual and revered visionary of the French avant-garde--proffers a lively reading of and guide to the famed libertine's sprawling memoir. Armine Kotin Mortimer's translation of Sollers's reading tracks the alluring Venetian through the whole of his astounding and disreputable life. Eschewing myth, Sollers dares to present the plain realities of a man "simple, direct, courageous, cultivated, seductive, funny. A philosopher in action." The lovers are here, and the ruses and adventures. But Sollers also rescues Casanova the writer, a gifted composer of words who reigns as a titan of eighteenth-century literature. As always, Sollers seeks to shame society for its failure to recognize its failings. By admiring those of Casanova's admirable qualities present in himself, Sollers spurns bourgeois hypocrisy and cliché to affirm a jocund philosophy of life devoted to the twinned pursuits of pleasure and joy. A masterful translation that captures Sollers's idiosyncratic style, Casanova the Irresistible escorts readers on a journey into the heads and hearts of two singular personalities.Fed, White, and Blue
By Simon Majumdar, Alton Brown. 2015
Simon Majumdar is probably not your typical idea of an immigrant. As he says, "I'm well rested, not particularly poor,…
and the only time I ever encounter 'huddled masses' is in line at Costco." But immigrate he did, and thanks to a Homeland Security agent who asked if he planned to make it official, the journey chronicled in Fed, White, and Blue was born. In it, Simon sets off on a trek across the United States to find out what it really means to become an American, using what he knows best: food.Simon stops in Plymouth, Massachusetts, to learn about what the pilgrims ate (and that playing Wampanoag football with large men is to be avoided); a Shabbat dinner in Kansas; Wisconsin to make cheese (and get sprayed with hot whey); and LA to cook at a Filipino restaurant in the hope of making his in-laws proud. Simon attacks with gusto the food cultures that make up America--brewing beer, farming, working at a food bank, and even finding himself at a tailgate. Full of heart, humor, history, and of course, food, Fed, White, and Blue is a warm, funny, and inspiring portrait of becoming American.Truck: A Love Story
By Michael Perry. 2006
The author of Population: 485 returns, delivering a truckload of humor, heart, and . . . gardening tips? Think Zen…
and the Art of Motorcycle Maintenance, complete with stock cars, sexy vegetables, and a laugh track."All I wanted to do was fix my old pickup truck," says Michael Perry. "That, and plant my garden. Then I met this woman. . . ." Truck: A Love Story recounts a year in which Perry struggles to grow his own food ("Seed catalogs are responsible for more unfulfilled fantasies than Enron and Penthouse combined"), live peaceably with his neighbors (one test-fires his black powder rifle in the alley; another's best Sunday shirt reads 100 PERCENT WHUP-ASS), and sort out his love life. But along the way, he sets his hair on fire, is attacked by wild turkeys, takes a date to the fire department chicken dinner, and proposes marriage to a woman in New Orleans. As with Population: 485, much of the spirit of Truck: A Love Story may be found in the characters Perry meets: a one-eyed land surveyor, a paraplegic biker who rigs a sidecar so that his quadriplegic pal can ride along, a bartender who refuses to sell light beer, an enchanting woman who never existed, and half the staff of National Public Radio.By turns hilarious and heartfelt, a tale that begins on a pile of sheep manure, detours to the Whitney Museum of American Art, and returns to the deer-hunting swamps of northern Wisconsin, Truck: A Love Story becomes a testament to the surprising and unintended consequences of love.1006Internet Governance: The NETmundial Roadmap

By Jessica Wiskus. 2013
Between present and past, visible and invisible, and sensation and idea, there is resonance--so philosopher Maurice Merleau-Ponty argued and so…
Jessica Wiskus explores in The Rhythm of Thought. Holding the poetry of Stéphane Mallarmé, the paintings of Paul Cézanne, the prose of Marcel Proust, and the music of Claude Debussy under Merleau-Ponty's phenomenological light, she offers innovative interpretations of some of these artists' masterworks, in turn articulating a new perspective on Merleau-Ponty's philosophy. More than merely recovering Merleau-Ponty's thought, Wiskus thinks according to it. First examining these artists in relation to noncoincidence--as silence in poetry, depth in painting, memory in literature, and rhythm in music--she moves through an array of their artworks toward some of Merleau-Ponty's most exciting themes: our bodily relationship to the world and the dynamic process of expression. She closes with an examination of synesthesia as an intertwining of internal and external realms and a call, finally, for philosophical inquiry as a mode of artistic expression. Structured like a piece of music itself, The Rhythm of Thought offers new contexts in which to approach art, philosophy, and the resonance between them.Enduring Truths
By Darcy Grimaldo Grigsby. 2015
Runaway slave Sojourner Truth gained fame in the nineteenth century as an abolitionist, feminist, and orator and earned a living…
partly by selling photographic carte de visite portraits of herself at lectures and by mail. Cartes de visite, similar in format to calling cards, were relatively inexpensive collectibles that quickly became a new mode of mass communication. Despite being illiterate, Truth copyrighted her photographs in her name and added the caption "I Sell the Shadow to Support the Substance. Sojourner Truth. " Featuring the largest collection of Truth's photographs ever published, Enduring Truths is the first book to explore how she used her image, the press, the postal service, and copyright laws to support her activism and herself. Darcy Grimaldo Grigsby establishes a range of important contexts for Truth's portraits, including the strategic role of photography and copyright for an illiterate former slave; the shared politics of Truth's cartes de visite and federal banknotes, which were both created to fund the Union cause; and the ways that photochemical limitations complicated the portrayal of different skin tones. Insightful and powerful, Enduring Truths shows how Truth made her photographic portrait worth money in order to end slavery--and also became the strategic author of her public self. But Enough About Me

By Steve Osborne. 2015
"HOW YA DOIN'?" With these four syllables, delivered in an unmistakably authentic New York accent, Steve Osborne has riveted thousands…
of people at the legendary storytelling venue The Moth (and many tens of thousands more via YouTube) with his hilarious, profane, and touching tales from his twenty years as an NYPD street cop. Steve Osborne is the real deal, people: the tough, streetwise New York cop of your dreams, one with a big, big heart. Kojak? NYPD Blue? Law & Order? Fuggedaboudem! The Job blows them out of the water. Steve Osborne has seen a thing or two in his years in the NYPD--some harmless, some definitely not. In "Stakeout," Steve and his partner mistake a Manhattan dentist for an armed robbery suspect, and reduce the man to a puddle of snot and tears when questioning him. In "Mug Shot," the mother of a suspected criminal makes a strange request and provides a sobering reminder of the humanity at stake in his profession. And in "Home," the image of Steve's family provides the adrenaline he needs to fight for his life when assaulted by two armed and violent crackheads. From stories about his days as a rookie cop to the time spent patrolling in the Anti-Crime Unit--and his visceral, harrowing recollections of working during the weeks after 9/11--The Job: True Tales from the Life of a New York City Cop captures the humanity, the absurdity, and the dark humor of police work, as well as the bravery of those who do it. These stories will speak to those nostalgic for the New York City of the 1980s and '90s, a bygone era when the city was a crazier, more dangerous (and possibly more interesting) place. From the Hardcover edition. One And Only Law: Walter Benjamin And The Second Commandment
By James Martel. 2014
Walter Benjamin's "Critique of Violence," widely considered his final word on law, proposes that all manifestations of law are false…
stand-ins for divine principles of truth and justice that are no longer available to human beings. However, he also suggests that we must have law--we are held under a divine sanction that does not allow us to escape our responsibilities. James R. Martel argues that this paradox is resolved by considering that, for Benjamin, there is only one law that we must obey absolutely--the Second Commandment against idolatry. What remains of law when its false bases of authority are undermined would be a form of legal and political anarchism, quite unlike the current system of law based on consistency and precedent. Martel engages with the ideas of key authors including Alain Badiou, Immanuel Kant, and H. L. A. Hart in order to revisit common contemporary assumptions about law. He reveals how, when treated in constellation with these authors, Benjamin offers a way for human beings to become responsible for their own law, thereby avoiding the false appearance of a secular legal practice that remains bound by occult theologies and fetishisms.Philadelphia Freedom
By David Kairys. 2008
"David Kairys is one of the grand long-distance runners in the struggle for justice in America. His brilliant legal mind…
and superb lawyerly skills are legendary. This marvelous book is his gift to us!" ---Cornel West, Professor of Religion and African American Studies, Princeton University, and award-winning author of Race Matters Philadelphia Freedom is the spellbinding tale of an idealistic young lawyer coming of age in the political cauldron of the 1960s and 1970s. From his immersion in the civil rights movement to his determined court battles to quell criminal violence by Philadelphia police, Kairys recounts how he helped make history in the city of brotherly love." ---William K. Marimow, Editor and Executive Vice President, Philadelphia Inquirer, and recipient of two Pulitzer Prizes "In the current climate of political deception and the trampling of our civil rights, Kairys's compelling book is a clenched fist, a prayer for social justice and a call to conscience." ---Steve Lopez, Los Angeles Times columnist and former Philadelphia Inquirer columnist "With engaging, insider stories of innovative legal strategies of a truly creative lawyer, this book evokes the ebullient spirit of progressive social change launched in the 1960s and should be read by aspiring and practicing lawyers as well as anyone interested in American social history. Philadelphia Freedom reads like a suspense novel and reveals how novel legal and political thinking can and does make a real difference to individuals and to the quality of justice." ---Martha L. Minow, Jeremiah Smith, Jr. Professor of Law, Harvard University "David Kairys's compelling book properly explains the vital role that civil rights attorneys play in our system of justice." ---Judge John E. Jones III, United States District Court for the Middle District of Pennsylvania, and presiding judge in the landmark Kitzmiller v. Dover Area School District case A memoir that is also a compelling page-turner, Philadelphia Freedom is the poignant, informative, often inspiring account of renowned civil-rights lawyer David Kairys's personal quest for achieving social justice during the turbulent 1960s and 70s. Philadelphia Freedom brings us intimately and directly into Kairys's burgeoning law career and the struggles of the 60s as his professional and private life navigated the turmoil and promise of the civil rights and antiwar movements. Many of the cases Kairys took on involved discrimination and equal protection, freedom of speech, and government malfeasance. Kairys is perhaps most well known for his victory in the Camden 28 draft board case, in which the FBI set up a sting of the Catholic anti-war left at the behest of the highest levels of government. The stories and cases range from nationally important and recognizable---the family of the scientist the CIA unwittingly gave LSD in the 1950s; the leading race discrimination case against the FBI; Dr. Benjamin Spock's First Amendment case before the Supreme Court; the city handgun lawsuits Kairys conceived---to those he encountered in his early work as a public defender. The characters include public figures such as FBI Directors J. Edgar Hoover and Louis Freeh; CIA Director William Colby; Pennsylvania Senator Arlen Specter; New York Attorney General Eliot Spitzer; U.S. Attorneys General Edward Levi and John Mitchell; Georgia Governor Lester Maddox; Pennsylvania Governor, former Philadelphia Mayor, and Democratic National Committee chair Ed Rendell; Philadelphia Mayor and Police Commissioner Frank Rizzo. But some of the most memorable are not well known, involving regular people caught up in the often heartless machinery of the courts and legal system. Though it reads like a novel, with all the elements of character, plot, and suspense, Philadelphia Freedom also has historical significance as a firsthand account of the 1960s and 70s and contains social commentary about race as well as insights and major perspectives on the nature and social r
