By Sam Lebovic. 2016
Does America have a free press? Many who say yes appeal to First Amendment protections against censorship. Sam Lebovic shows…
that free speech, on its own, is not sufficient to produce a free press and helps us understand the crises that beset the press amid media consolidation, a secretive national security state, and the daily newspaper's decline.Biologically Modified Justice
By Colin Farrelly. 2016
Theories of distributive justice tend to focus on the issue of what constitutes a fair division of 'external' goods and…
opportunities; things like wealth and income, opportunities for education and basic liberties and rights. However, rapid advances in the biomedical sciences have ushered in a new era, one where the 'genetic lottery of life' can be directly influenced by humans in ways that would have been considered science fiction only a few decades ago. How should theories of justice be modified to take seriously the prospect of new biotechnologies, especially given the health challenges posed by global aging? Colin Farrelly addresses a host of topics, ranging from gene therapy and preimplantation genetic diagnosis, to an 'anti-aging' intervention and the creation and evolution of patriarchy. This book aims to foster the interdisciplinary dialogue needed to ensure we think rationally and cogently about science and science policy in the twenty-first century. The Human Face of the European Union
By Nuno Ferreira, Dora Kostakopoulou, Julia Bradshaw, Swati Gola. 2016
This collection asks a direct but complex question: is the EU humane enough? The implementation of EU law and policy…
and its balance between economic and social values continues to provoke debate. Providing fresh insight, Nuno Ferreira and Dora Kostakopoulou present a novel analytical framework, centred on the notion of humaneness, for assessing EU law and policy. This innovative approach leads to recommendations for policy change towards a more humanistic philosophy for the EU. Broad in its scope, this remarkable volume draws together interdisciplinary perspectives from contributors who examine key EU law and policy fields, including economic integration, asylum and free movement, citizenship and development, and security. This book is essential reading for scholars, students and policy-makers seeking new ways of exploring the economic versus social values debate in EU law.Governing the Commons
By Elinor Ostrom. 1990
Congratulations to Elinor Ostrom, Co-Winner of The Sveriges Riksbank Prize in Economic Sciences in Memory of Alfred Nobel 2009!The governance…
of natural resources used by many individuals in common is an issue of increasing concern to policy analysts. Both state control and privatization of resources have been advocated, but neither the state nor the market have been uniformly successful in solving common pool resource problems. After critiquing the foundations of policy analysis as applied to natural resources, Elinor Ostrom here provides a unique body of empirical data to explore conditions under which common pool resource problems have been satisfactorily or unsatisfactorily solved. Dr. Ostrom first describes three models most frequently used as the foundation for recommending state or market solutions. She then outlines theoretical and empirical alternatives to these models in order to illustrate the diversity of possible solutions. In the following chapters she uses institutional analysis to examine different ways--both successful and unsuccessful--of governing the commons. In contrast to the proposition of the tragedy of the commons argument, common pool problems sometimes are solved by voluntary organizations rather than by a coercive state. Among the cases considered are communal tenure in meadows and forests, irrigation communities and other water rights, and fisheries. No Child Left Alone: Getting the Government Out of Parenting

Not anymore. As a mom to four kids, I should be used to it, but I'm not. All the government-mandated parenting gets under my skin. And I'm not alone. No Child Left Alone explores the growing problem of an intrusive, interfering government and highlights those parents-all the Captain Mommies and Captain Daddies across America-fighting to take back control over their families. The Court and the World: American Law and the New Global Realities
By Stephen Breyer. 2015
In this original, far-reaching, and timely book, Justice Stephen Breyer examines the work of the Supreme Court of the United…
States in an increasingly interconnected world, a world in which all sorts of activity, both public and private--from the conduct of national security policy to the conduct of international trade--obliges the Court to understand and consider circumstances beyond America's borders. It is a world of instant communications, lightning-fast commerce, and shared problems (like public health threats and environmental degradation), and it is one in which the lives of Americans are routinely linked ever more pervasively to those of people in foreign lands. Indeed, at a moment when anyone may engage in direct transactions internationally for services previously bought and sold only locally (lodging, for instance, through online sites), it has become clear that, even in ordinary matters, judicial awareness can no longer stop at the water's edge. To trace how foreign considerations have come to inform the thinking of the Court, Justice Breyer begins with that area of the law in which they have always figured prominently: national security in its constitutional dimension--how should the Court balance this imperative with others, chiefly the protection of basic liberties, in its review of presidential and congressional actions? He goes on to show that as the world has grown steadily "smaller," the Court's horizons have inevitably expanded: it has been obliged to consider a great many more matters that now cross borders. What is the geographical reach of an American statute concerning, say, securities fraud, antitrust violations, or copyright protections? And in deciding such matters, can the Court interpret American laws so that they might work more efficiently with similar laws in other nations? While Americans must necessarily determine their own laws through democratic process, increasingly, the smooth operation of American law--and, by extension, the advancement of American interests and values--depends on its working in harmony with that of other jurisdictions. Justice Breyer describes how the aim of cultivating such harmony, as well as the expansion of the rule of law overall, with its attendant benefits, has drawn American jurists into the relatively new role of "constitutional diplomats," a little remarked but increasingly important job for them in this fast-changing world. Written with unique authority and perspective, The Court and the World reveals an emergent reality few Americans observe directly but one that affects the life of every one of us. Here is an invaluable understanding for lawyers and non-lawyers alike. From the Hardcover edition.Cambridge Studies in International and Comparative Law: Exclusion from Public Space
By Daniel Moeckli. 2016
Hardly known twenty years ago, exclusion from public space has today become a standard tool of state intervention. Every year,…
tens of thousands of homeless individuals, drug addicts, teenagers, protesters and others are banned from parts of public space. The rise of exclusion measures is characteristic of two broader developments that have profoundly transformed public space in recent years: the privatisation of public space, and its increased control in the 'security society'. Despite the fundamental problems it raises, exclusion from public space has received hardly any attention from legal scholars. This book addresses this gap and comprehensively explores the implications that this new form of intervention has for the constitutional essentials of liberal democracy: the rule of law, fundamental rights, and democracy. To do so, it analyses legal developments in three liberal democracies that have been at the forefront of promoting exclusion measures: the United Kingdom, the United States, and Switzerland.Cambridge Studies in Law and Society: Contractual Knowledge
By Gr goire Mallard, J r me Sgard. 2016
Contractual Knowledge: One Hundred Years of Legal Experimentation in Global Markets, edited by Grégoire Mallard and Jérôme Sgard, extends the…
scholarship of law and globalization in two important directions. First, it provides a unique genealogy of global economic governance by explaining the transition from English law to one where global exchanges are primarily governed by international, multilateral, and finally, transnational legal orders. Second, rather than focusing on macro-political organizations, like the League of Nations or the International Monetary Fund, the book examines elements of contracts, including how and by whom they were designed and exactly who (experts, courts, arbitrators, and international organizations) interpreted, upheld, and established the legal validity of these contracts. By exploring such micro-level aspects of market exchanges, this collection unveils the contractual knowledge that led to the globalization of markets over the last century.State Food Crimes
By Howard-Hassmann, Rhoda E.. 2016
Some states deny their own citizens one of the most fundamental human rights: the right to food. Rhoda E. Howard-Hassmann,…
a leading scholar of human rights, discusses state food crimes, demonstrating how governments have introduced policies that cause malnutrition or starvation among their citizens and others for whom they are responsible. The book introduces the right to food and discusses historical cases (communist famines in Ukraine, China and Cambodia, and neglect of starvation by democratic states in Ireland, Germany and Canada). It then moves to a detailed discussion of four contemporary cases: starvation in North Korea, and malnutrition in Zimbabwe, Venezuela, and the West Bank and Gaza. These cases are then used to analyse international human rights law, sanctions and food aid, and civil and political rights as they pertain to the right to food. The book concludes by considering the need for a new international treaty on the right to food.A Company's Right to Damages for Non-Pecuniary Loss
By Vanessa Wilcox. 2016
Applying appropriate legal rules to companies with as much consistency and as little consternation as possible remains a challenge for…
legal systems. One area causing concern is the availability of damages for non-pecuniary loss to companies, a disquiet that is rooted in the very nature of such damages and of companies themselves. In this book, Vanessa Wilcox presents a detailed examination of the extent to which damages for non-pecuniary loss can be properly awarded to companies. The book focusses on the jurisprudence of the European Court of Human Rights and English law, with a chapter also dedicated to comparative treatment. While the law must be adaptable, Wilcox concludes that considerations of coherency, certainty and ultimately justice dictate that the resulting rules should conform to certain core legal principles. This book lays the foundation for further comparative research into this topic and will be of interest to both the tort law and broader legal community.Comparative Constitutional Law and Policy: Assessing Constitutional Performance
By Tom Ginsburg, Huq, Aziz Z.. 2016
From London to Libya, from Istanbul to Iceland, there is great interest among comparative constitutional scholars and practitioners about when…
a proposed constitution is likely to succeed. But what does it mean for a constitution to succeed? Are there universal criteria of success, and which apply across the board? Or, is the choice of criteria entirely idiosyncratic? This edited volume takes on the idea of constitutional success and shows the manifold ways in which it can be understood. It collects essays from philosophers, political scientists, empiricists and legal scholars, that approach the definition of constitutional success from many different angles. It also brings together case studies from Africa, Europe, Latin America, the Middle East and Asia. By exploring a varied array of constitutional histories, this book shows how complex ideas of constitutional success play out differently in different contexts and provides examples of how success can be differently defined under different circumstances.LSAT Reading Comprehension: Strategy Guide + Online Tracker

By Daniel J Solove. 2004
Seven days a week, twenty-four hours a day, electronic databases are compiling information about you. As you surf the Internet,…
an unprecedented amount of your personal information is being recorded and preserved forever in the digital minds of computers. For each individual, these databases create a profile of activities, interests, and preferences used to investigate backgrounds, check credit, market products, and make a wide variety of decisions affecting our lives. The creation and use of these databases--which Daniel J. Solove calls "digital dossiers"--has thus far gone largely unchecked. In this startling account of new technologies for gathering and using personal data, Solove explains why digital dossiers pose a grave threat to our privacy. The Digital Person sets forth a new understanding of what privacy is, one that is appropriate for the new challenges of the Information Age. Solove recommends how the law can be reformed to simultaneously protect our privacy and allow us to enjoy the benefits of our increasingly digital world. The first volume in the series EX MACHINA: LAW, TECHNOLOGY, AND SOCIETYMoral Imperialism: A Critical Anthology
By Hernndez-Truyol. 2002
In the controversy over female genital mutilation, Congress was quick to condemn practices throughout Africa and the Middle East and…
to take action criminalizing the practice domestically. Yet at the same time, it bluntly dismissed Amnesty International and Human Rights Watch when they pointed out human rights violations closer to home in the form of the disproportionately high rate of the imposition of capital punishment on black men, and the disempowerment of poor women under new draconian welfare rules. The irony of the United States' international condemnation of types of activities in which it engages within its own borders is not lost on Third World critics. Moral Imperialism sets out to bring an international human rights framework to the analysis of current international and domestic legal, political, and cultural crises. It explores the United States' moral supremacy during a time of clear domestic shortcomings and asks whether insisting that other nations adhere to norms that derive from dominant U. S. culture and history may harm societies--both within and outside of the U. S. --with radically different cultures and histories. Contributors: Beverly Greene, Kevin Johnson, M.
