im Bereich des öffentlichen Auftragswesens stellen Gemeinkosten im Rahmen der kostenbasierten LSP-Kalkulation den größten Anteil bei der Selbstkostenpreisbildung dar. In der vorliegenden Arbeit werden sowohl theoriebasierte als auch empirische Antworten auf einen preisrechtskonformen Umgang mit Gemeinkosten gegeben. Anhand einer Feldstudie mit 24 Preisrechtsanwendern sowie einer ergänzenden Tiefenfallstudie mit einem Dienstleistungsunternehmen aus dem Bereich des öffentlichen Preisrechts wurden die zuvor gewonnenen theoriebasierten Erkenntnisse mit Einblicken in die betriebliche Praxis gespiegelt. Die Ergebnisse beider Studien zeigen, dass der öffentliche Auftraggeber häufig lenkend in das interne Rechnungswesen seiner Auftragnehmer eingreift. Zudem wird vor allem die Umwidmung von Gemeinkostenbestandteilen zu Einzelkosten als strategisches Instrument genutzt, um deren Abrechenbarkeit gegenüber öffentlichen Auftraggebern und deren Prüfsicherheit im Rahmen der Preisprüfung zu erhöhen. Auf Basis des theoretischen als auch empirischen Erkenntnisgewinns konnten darüber hinaus zahlreiche Implikationen für die unternehmerische Praxis der Preisrechtsanwender gewonnen werden.

In doing so, the analysis spans more than three decades, from the quasi-accidental onset of the first food aid program in the late 1980s under the Common Agricultural Policy to its current, puzzling, and contested consolidation as a narrow yet symbolic element of Social Europe's architecture. More precisely, the study offers an in-depth examination of the governance and implementation of European Food Aid Policy (EFAP) while exploring the political and institutional dynamics shaping its trajectory over time. Deploying primarily a historical institutionalist approach, the book addresses two key questions: Why did EFAP emerge despite the EU&’s limited role in anti-poverty policies? And how did it survive and consolidate, particularly during the 2008–2014 critical juncture, despite growing adverse conditions? By treating EFAP as a &“least-likely case&” for European integration, the research sheds light on broader political and institutional dynamics behind the making of Social Europe. Case studies investigate the diversity of cultural governance as an analytical tool for historical heritage management, from the protection of antiquities and guardianship of holy shrines to the use of heritage for corporate legitimacy, the dissemination of conservation expertise throughout the Arab world, and management of heritage in times of conflict. This material explores negotiations of power and sovereignty between local caretakers, officials of the Mandate administration, members of the Iraqi and Arab intelligentsia, UNESCO consultants, and Iraqi state officials, among others, underlining the ideological pluralism of governance efforts throughout the period. This research offers a historical analysis of cultural projects and programs in Iraq to consider the sociopolitical conditions that shaped their governance. While there is ample literature on bilateral and regional FTAs, it is often limited to the contractual obligations assumed by the participating countries. This book goes a step further and analyses how these obligations are implemented through national legislation, institutional changes and legal practice. To provide a deeper understanding of the effects of FTAs on national IP systems, the book addresses research questions that go beyond general publications on the topic. Research questions include: Is the combination of market access and IP rules in a bilateral FTA an effective and appropriate trade deal? How are the IP requirements under the FTAs implemented into the national statutory framework? Do the IP rules of FTAs sufficiently address institutional factors necessary for an effective IP system?
