were shocking: across the country, in big cities and small towns, the system was dismissing a high number of allegations as "unfounded." A police officer would simply view the claim as baseless and no investigation would follow. Of the 26,500 reported cases of sexual assault in 2015, only 1,400 resulted in convictions. The response to Doolittle's groundbreaking Unfounded series was swift. Federal ministers immediately vowed to establish better oversight, training, and policies; Prime Minister Trudeau announced {dollar}100 million to combat gender-based violence; Statistics Canada began to collect and publish unfounded rates; and to date, about a third of the country's forces have pledged to review more than 10,000 sex-assault cases dating back to 2010. Had It Coming picks up where the Unfounded series left off. Doolittle brings a personal voice to what has been a turning point for most women: the #MeToo movement and its aftermath. The world is now increasingly aware of the pervasiveness of rape culture in which powerful men got away with sexual assault and harassment for years: from Bill Cosby, Harvey Weinstein, Bill O'Reilly, and Matt Lauer, to Charlie Rose and Jian Ghomeshi. But Doolittle looks beyond specific cases to the big picture. The issue of "consent" figures largely: not only is the public confused about what it means, but an astounding number of police officers and judges do not understand Canadian consent law. The brain's reaction to trauma and how it affects memory is also crucial to understanding victim statements. Surprisingly, Canada has the most progressive sexual assault laws in the developed world, yet the system is failing victims at every stage. 2019.

The American economy has radically transformed in the past half-century, led by advances in automation technology that have permanently altered labor market dynamics. Over the same period, the U.S. criminal justice system experienced an unprecedented expansion at great cost.  These costs include not only the $80 billion annually in direct expenditures on criminal justice, but also the devastating impacts experienced by justice-involved individuals, families, and communities.    Recently, a widespread consensus has emerged that the era of “mass incarceration” is at an end, reflected in a declining prison population. Criminal justice reforms such as diversion and problem-solving courts, a renewed focus on reentry, and drug policy reform have as their goal keeping more individuals with justice system involvement out of prisons, in the community and subsequently in the labor force, which lacks the capacity to accommodate these additional would-be workers. This poses significant problems for criminal justice practice, which relies heavily on employment as a signal of offenders’ intentions to live a law-abiding lifestyle. The diminished capacity of the economy to utilize the labor of all who have historically been expected to work presents significant challenges for American society. Work, in the American ethos is the marker of success, masculinity and how one “contributes to society.” What are the consequences of ignoring these converging structural trends? This book examines these potential consequences, the meaning of work in American society, and suggests alternative redistributive and policy solutions to avert the collision course of these economic and criminal justice policy trends.

This debate has raged in Western Europe and in the United States at least since the late eighteenth century. Joseph F. Spillane examines the failure of progressive reform in New York State by focusing on Coxsackie, a New Deal reformatory built for young male offenders. Opened in 1935 to serve "adolescents adrift," Coxsackie instead became an unstable and brutalizing prison. From the start, the liberal impulse underpinning the prison’s mission was overwhelmed by challenges it was unequipped or unwilling to face—drugs, gangs, and racial conflict.Spillane draws on detailed prison records to reconstruct a life behind bars in which "ungovernable" young men posed constant challenges to racial and cultural order. The New Deal order of the prison was unstable from the start; the politics of punishment quickly became the politics of race and social exclusion, and efforts to save liberal reform in postwar New York only deepened its failures. In 1977, inmates took hostages to focus attention on their grievances. The result was stricter discipline and an end to any pretense that Coxsackie was a reform institution.Why did the prison fail? For answers, Spillane immerses readers in the changing culture and racial makeup of the U.S. prison system and borrows from studies of colonial prisons, which emblematized efforts by an exploitative regime to impose cultural and racial restraint on others.In today’s era of mass incarceration, prisons have become conflict-ridden warehouses and powerful symbols of racism and inequality. With Dick’s allegorical inspiration, the authors of Criminal Law and Precrime: Legal Studies in Canadian Punishment and Surveillance in Anticipation of Criminal Guilt posit that recent developments in Canadian law indicate a trend toward imposing punitive measures at increasingly earlier stages of the prosecutorial process. The result is a potentially new field of criminal management that could be characterized as "precrime"—particularly the use of the law as a technology of surveillance and prevention since "terror" became a justification for intervention. The authors note that as risk management logics (based in actuarial sciences) have shifted to precautionary ones (based in administrative sciences), the law has responded by developing techniques in the arena of criminal regulation in light of the "war on terror": the need to ensure security, the proliferation of digital data, and the development of drones, social networking, and cloud storage to gather personal data. The authors view shifts in criminal investigation; the substantive criminal law of sexual expression, conduct, and work; and civil forfeiture as emblematic of precrime populism. The unifying theme of these techniques is that they occur prior to state-identified crime, arise out of a precautionary philosophy, and seek to presume (or circumvent) criminality. The book is a provocative read for scholars and students in criminal law, policing, and surveillance, as well as for those interested in how areas of law, such as immigration, health, and anti-terrorism, are mobilizing the logics of risk and surveillance in new ways that emphasize precaution. The authors invite legal scholars to place the analytical lens of precrime on criminal and regulatory practices in Canada as well as other Western nations across the globe.

The United States, celebrated as a nation of immigrants and the land of the free, has developed the most extensive system of imprisonment and deportation that the world has ever known. The Deportation Express is the first history of American deportation trains: a network of prison railroad cars repurposed by the Immigration Bureau to link jails, hospitals, asylums, and workhouses across the country and allow forced removal with terrifying efficiency. With this book, historian Ethan Blue uncovers the origins of the deportation train and finds the roots of the current moment, as immigrant restriction and mass deportation once again play critical and troubling roles in contemporary politics and legislation. A century ago, deportation trains made constant circuits around the nation, gathering so-called "undesirable aliens"—migrants disdained for their poverty, political radicalism, criminal conviction, or mental illness—and conveyed them to ports for exile overseas. Previous deportation procedures had been violent, expensive, and relatively ad hoc, but the railroad industrialized the expulsion of the undesirable. Trains provided a powerful technology to divide "citizens" from "aliens" and displace people in unprecedented numbers. Drawing on the lives of migrants and the agents who expelled them, The Deportation Express is history told from aboard a deportation train. By following the lives of selected individuals caught within the deportation regime, this book dramatically reveals how the forces of state exclusion accompanied epic immigration in early twentieth-century America.
