By Gui Huang. 2024
This book presents a study of alternative penalties to the death penalty in China, aiming to promote theoretical exploration of…
death penalty reform in China as well as long-term penal reform. Currently, China is endeavouring to control the use of the death penalty and is gradually moving towards its abolition. The factors influencing the choice of the punishment option to replace the death penalty are complex and varied and include the traditional punishment culture, penalty concepts, the political system, the punishment system, public opinion and human rights, etc. Given the differences between China and developed Western democratic states, when we examine these influencing factors, we cannot ignore the culture of the punishment and the special political and legislation system in China. In this light, this work examined and analysed the factors that influence the choice of punishment option to replace the death penalty in this special political system with its clearly Chinese characteristics. Criminal policy and public opinion are two significant and typical factors involving obvious political considerations in China. The former normally reflects and carries out the will of the Government as expressed to the national management; the latter responds to the majority of citizens’ view on the current legal system and it is, to a great extent, the basis for national leadership’s running of the country. Even though life imprisonment without release (hereinafter, LWOR) has been stipulated by the Ninth Amendment for the crime of corruption, it should not be the preferable option as the alternative sanction to the death penalty because it is a kind of cruel torture and violates the constitutional principle of human rights protection. On the contrary, life imprisonment with possibility of release (hereinafter, LWPR) would be an option, but the termination mechanisms for inmates should be set out in accordance with the principle of proportional justice; aggravatedlife imprisonment can be chosen to replace the death penalty in China. In addition, there needs to be improvements made to the relevant criminal systems. By examining China's death penalty reform and long-term imprisonment reform, this book not only explains the methodology of the reform theoretically, but also pays attention to the issues of legislation and judicial practice. This book is of interest to scholars and researchers in the fields of criminal justice, penal reform issues, and crime control in China. The Sensory Child Gets Organized: Proven Systems for Rigid, Anxious, or Distracted Kids

By Evan Wolfson. 2003
"At its core, the freedom-to-marry movement is about the same thing every civil rights struggle has been about: taking seriously…
our country's promise to be a nation its citizens can make better, its promise to be a place where people don't have to give up their differences or hide them in order to be treated equally."Why Marriage Matters offers a compelling, intelligently reasoned discussion of a question that still remains in the national consciousness. It is the work of one of the most influential attorneys in America, who has dedicated his life to the protection of individuals' rights and our Constitution's commitment to equal justice under the law. Above all, it is a clear, straightforward book that brings into sharp focus the very human significance of the right to marry in America—not just for some couples, but for all.Why is the word marriage so important? Will marriage for same-sex couples hurt the "sanctity" of the institution? How can people of different faiths reconcile their beliefs with the idea of marriage for same-sex couples? How will allowing gay couples to marry affect children? In this quietly powerful volume, the most authoritative and fairly articulated book on the subject, Wolfson demonstrates why the right to marry is important—indeed necessary—for all couples and for America's promise of equality.Wolf Boys: Two American Teenagers and Mexico's Most Dangerous Drug Cartel
By Dan Slater. 2016
The tale of two American teenagers recruited as killers for a Mexican cartel, and the Mexican American detective who realizes…
the War on Drugs is unstoppable. &“A hell of a story…undeniably gripping.&” (The New York Times)In this astonishing story, journalist Dan Slater recounts the unforgettable odyssey of Gabriel Cardona. At first glance, Gabriel is the poster-boy American teenager: athletic, bright, handsome, and charismatic. But the ghettos of Laredo, Texas—his border town—are full of smugglers and gangsters and patrolled by one of the largest law-enforcement complexes in the world. It isn’t long before Gabriel abandons his promising future for the allure of juvenile crime, which leads him across the river to Mexico’s most dangerous drug cartel: Los Zetas. Friends from his childhood join him and eventually they catch the eye of the cartel’s leadership. As the cartel wars spill over the border, Gabriel and his crew are sent to the States to work. But in Texas, the teen hit men encounter a Mexican-born homicide detective determined to keep cartel violence out of his adopted country. Detective Robert Garcia’s pursuit of the boys puts him face-to-face with the urgent consequences and new security threats of a drug war he sees as unwinnable. In Wolf Boys, Slater takes readers on a harrowing, often brutal journey into the heart of the Mexican drug trade. Ultimately though, Wolf Boys is the intimate story of the lobos: teens turned into pawns for the cartels. A nonfiction thriller, it reads with the emotional clarity of a great novel, yet offers its revelations through extraordinary reporting. You've heard about cases of Asperger's, or perhaps have known a child with the syndrome. By Joaquin Jack Garcia, Michael Levin. 2009
"Petey Chops wasn't kicking up. And if he didn't start soon, he was going to get whacked." So begins Making…
Jack Falcone, the extraordinary true story of an undercover FBI agent's years-long investigation of the Gambinos, which resulted in a string of arrests that crippled the organized crime family. But long before Joaquin "Jack" Garcia found himself wearing a wire with some of the Mafia's top capos, he was one of the FBI's unlikeliest recruits. A Cuban-born American, Jack graduated from Quantico standing six-foot-four and weighing 300 pounds -- not your typical G-man. Jack's stature soon proved an asset as the FBI looked to place agents undercover with drug smugglers, counterfeiters, and even killers. Jack became one of the few FBI agents dedicated solely to undercover work. Using a series of carefully created aliases, Jack insinuated himself in the criminal world, from the Badlands of Philadelphia, where he was a gregarious money launderer, to the streets of Miami, where an undercover Garcia moved stolen and illicit goods and brought down dirty cops. Jack jumped at the opportunity to infiltrate the shadowy world of La Cosa Nostra, but how would the Cuban-American convince wiseguys that he was one of their own, a Sicilian capable of "earning his button" -- getting made in the Mafia? For the first time, the FBI created a special "mob school" for Jack, teaching him how to eat, talk, and think like a wiseguy. And it wasn't long before the freshly minted Jack Falcone found himself under the wing of one of the Gambinos' old school capos, Greg DePalma. DePalma, who cared for an ailing John Gotti in prison, introduced Falcone to his world of shakedowns, beatings, and envelopes of cash, never suspecting that one of his trusted crew members was a federal agent. A page-turning account of the struggle between law enforcement and organized crime that will rank with such classic stories as Donnie Brasco, Serpico, and Wiseguy, Making Jack Falcone is an unforgettable trip into America's underworld through the eyes of a highly decorated FBI veteran.Essential information for executors or trustees for wills and trusts!Being appointed the task of carrying out the terms of a…

By Kim Isaac Eisler. 2001
In the mid-1970s, the Mashantucket Pequot tribe had only one member -- an elderly woman who pleaded with her grandson…
to come live on the impoverished reservation and save it from falling into government hands upon her death. In Revenge of the Pequots, journalist Kim Isaac Eisler tells the remarkable story of how Richard "Skip" Hayward, then an unemployed ship-worker, granted his grandmother's dying wish, revived the moribund clan, and transformed the Pequots into the richest and most influential band of Native Americans in history. Established in 1992, Foxwoods Resort and Casino is the world's most profitable gambling establishment, grossing over $1 billion a year at its sprawling complex in the backwoods of Ledyard, Connecticut. Making use of arcane laws and court decisions never intended to benefit Native Americans as they have, Hayward brilliantly laid the groundwork for this staggering economic empire. In a story rife with drama, he challenged a succession of Connecticut governors and such worthy adversaries as casino moguls Steve Wynn and Donald Trump, while forming alliances with Malaysian industrialist Lim Goh Tong, renegade Seminole chief James Billie, and President Bill Clinton. As a result of Hayward's strategizing, for one of the few times in history -- and in a truly ironic reversal -- the bizarre legal structure governing Native Americans actually worked to their advantage in a mainstream enterprise. But the Pequots' meteoric rise to fortune has left many wondering: Is this turnabout fair play? In this riveting rags-to-riches tale, Eisler deftly explores the wide-ranging issues that have framed the great Native American casino debate and the ramifications of the Native American casino boom in a nation still uneasy about its roots. The European Union as a Normative Power: The Role of the CJEU (Routledge Research in EU Law)
By Yuval Reinfeld. 2024
Examining the role of the CJEU in shaping the European Union as a Normative power, this book explores the influence…
of the Court of Justice of the European Union on Normative Power Europe to evaluate the extent to which the CJEU’s actions consolidate normative foreign policy in third states. Combining perspectives from international relations and law, it explores the EU’s normative impact in the international arena, offering a multidimensional view which characterizes the power of the EU as a normative power while examining its role as a regulatory power alongside a historical review of the legal doctrinal development of the CJEU. Distilling the EU's uniqueness in the international arena and emphasizing that its fundamental strength lies in the technical normative power approach, the book argues that the genuine EU impact is emphasized in unique sectoral niches noting the EU’s dominance in terms of agriculture, environmental protection, privacy, and data protection or tech policies- a classic technical normative power that combines a legal basis and a value base. The book analyses several case studies which present the triangular relations between CJEU rulings, EU institutions, and third countries to identify both direct and indirect signs of a genuine normative effect. Taking an interdisciplinary approach, this book will be of interest to academics and students researching aspects of European law, international law, or international relations.researchSEND in Ordinary Classrooms

By Kris Maher. 2021
Set in Appalachian coal country, this &“superb&” (Pittsburgh Post-Gazette) legal drama follows one determined lawyer as he faces a coal…
industry giant in a seven-year battle over clean drinking water for a West Virginia community. For two decades, the water in the taps and wells of Mingo County didn&’t look, smell, or taste right. Could the water be the root of the health problems—from kidney stones to cancer—in this Appalachian community? Environmental lawyer Kevin Thompson certainly thought so.For seven years, Thompson waged an epic legal battle against Massey Energy, West Virginia&’s most powerful coal company, helmed by CEO Don Blankenship. While Massey&’s lawyers worked out of a gray glass office tower in Charleston known as &“the Death Star,&” Thompson set up shop in a ramshackle hotel in the fading coal town of Williamson. Working with fellow lawyers and a crew of young activists, Thompson would eventually uncover the ruthless shortcuts that put the community&’s drinking water at risk.Retired coal miners, women whose families had lived in the area&’s coal camps for generations, a respected preacher and his brother, all put their trust in Thompson when they had nowhere else to turn. Desperate is a masterful work of investigative reporting about greed and denial, &“both a case study in exploitation of the little guy and a playbook for confronting it&” (Kirkus Reviews). Maher crafts a revealing portrait of a town besieged by hardship and heartbreak, and an inspiring account of one tenacious environmental lawyer&’s mission to expose the truth and demand justice.
