Law and the Epistemologies of the South (Cambridge Studies in Law and Society)
By Boaventura de Sousa Santos. 2023
Modern state law excludes populations, peoples, and social groups by making them invisible, irrelevant, or dangerous. In this book, Boaventura…
de Sousa Santos offers a radical critique of the law and develops an innovative paradigm of socio-legal studies which is based on the historical experience of the Global South. He traces the history of modern law as an abyssal law, or a kind of law that is theoretically invisible yet implements profound exclusions in practice. This abyssal line has been the key procedure used by modern modes of domination – capitalism, colonialism, and patriarchy – to divide people into two groups, the metropolitan and the colonial, or the fully human and the sub-human. Crucially, de Sousa Santos rejects the decadent pessimism that claims that we are living through 'the end of history'. Instead, this book offers practical, hopeful alternatives to social exclusion and modern legal domination, aiming to make post-abyssal legal utopias a reality.Explainable Artificial Intelligence (Biomedical and Robotics Healthcare)

By Matej Accetto, Katja Škrubej, Joseph H. H. Weiler. 2024
The last one hundred years have seen a number of events that could be perceived as disruptive challenges to the…
normal operation of the legal order. Some have been disruptive innovations of technologies or business practices, others social changes or constitutional transformations, further buttressed by the impact of globalisation and interdependence affecting the development of international, transnational and global law. Coincidentally, this period of one hundred years has been bookended by two pandemics, themselves disruptive realities testing the resilience as well as the adaptability of the legal regimes. A hundred years ago, the founding dean of a newly established law faculty beginning its mission amid the ashes of the First World War and the disintegration of the only remaining European empire gave an opening lecture exploring the role of law and judges in the face of revolutionary societal changes. Drawing upon that important text, this edited volume explores similar challenges for law brought about by various disruptive realities. The collection looks at the past as well as the future. Following the text of the opening lecture by Pitamic, the contributions are grouped under five headings, dealing with the law and revolution in 1918, the challenges posed for law by the seemingly more gradual political or technological transformations, the effects of globalisation and the changing world, with the final contributions reassessing the law, its methodologies and traditional paradigms including, in the epilogue, the challenges posed for law the recent disruptive reality of the Covid-19 pandemic. The book will be of interest to academics, researchers and policy-makers working in the areas of legal history, jurisprudence, constitutional law, law and politics, and law and technology. The Color of Precision Medicine (Routledge Studies in Science, Technology and Society)
By Shirley Sun, Zoe Ong. 2024
Will genome-based precision medicine fix the problem of race/ethnicity-based medicine? To answer this question, Sun and Ong propose the concept…
of racialization of precision medicine, defined as the social processes by which racial/ethnic categories are incorporated (or not) into the development, interpretation, and implementation of precision medicine research and practice.Drawing on interview data with physicians and scientists in the field of cancer care, this book addresses the following questions: Who are the racializers in precision medicine, how and why do they do it? Under what conditions do clinicians personalize medical treatments in the context of cancer therapies? The chapters elucidate different ways in which racialization occurs and reveal that there exists an inherent contradiction in the usage of race/ethnicity as precision medicine moves from bench to bedside. The relative resources theory is proposed to explain that whether race/ethnicity-based medicine will be replaced by genomic medicine depends on the resources available at the individual and systemic levels. Furthermore, this book expands on how racialization happens not only in pharmacogenomic drug efficacy studies, but also in drug toxicity studies and cost-effectiveness studies. An important resource for clinicians, researchers, public health policymakers, health economists, and journalists on how to deracialize precision medicine.A Body Made of Glass: A Cultural History of Hypochondria
By Caroline Crampton. 2024
Part cultural history, part literary criticism, and part memoir, A Body Made of Glass is a definitive biography of hypochondria.Caroline Crampton’s life was upended at…
the age of seventeen, when she was diagnosed with Hodgkin’s lymphoma, a relatively rare blood cancer. After years of invasive treatment, she was finally given the all clear. But being cured of the cancer didn’t mean she felt well. Instead, the fear lingered, and she found herself always on the alert, braced for signs that the illness had reemerged. Now, in A Body Made of Glass, Crampton has drawn from her own experiences with health anxiety to write a revelatory exploration of hypochondria—a condition that, though often suffered silently, is widespread and rising. She deftly weaves together history, memoir, and literary criticism to make sense of this invisible and underexplored sickness. From the earliest medical case of Hippocrates to the literary accounts of sufferers like Virginia Woolf and Marcel Proust to the modern perils of internet self-diagnosis, Crampton unspools this topic to reveal the far-reaching impact of health anxiety on our physical, mental, and emotional health. At its heart, Crampton explains, hypochondria is a yearning for knowledge. It is a never-ending attempt to replace the edgeless terror of uncertainty with the comforting solidity of a definitive explanation. Through intimate personal stories and compelling cultural perspectives, A Body Made of Glass brings this uniquely ephemeral condition into much-needed focus for the first time.Traitor By Default: The Trials of Kanao Inouye, the Kamloops Kid
By Patrick Brode. 2024
At the end of World War II, a young Japanese Canadian would stand trial and face execution for having committed…
war crimes and betraying his country. One of the most bizarre stories to emerge at the end of the Second World War was that of Kanao Inouye. Born in Kamloops, B.C., in 1916, he had relocated to his ancestral homeland of Japan, and by 1942 was a translator for the Japanese army. He was assigned to the prisoner of war camp in Hong Kong where he became infamous as one of the “most sadistic guards” over the Canadian survivors of the Battle of Hong Kong. Scores of prisoners would attest to his brutality administered in revenge for the treatment he had received growing up in Canada. His reputation was such that he was quickly apprehended after the war and faced charges of war crimes. But his subsequent trials became mired in questions as to who he really was. Was he a Canadian forced to serve in the Japanese military machine? Or was he a devoted soldier of his emperor obeying his superiors?Women, Business and the Law 2024 (Women, Business and the Law)
By World Bank. 2024
Women, Business and the Law 2024 is the 10th in a series of annual studies measuring the enabling conditions that…
affect women’s economic opportunity in 190 economies. To present a more complete picture of the global environment that enables women’s socioeconomic participation, this year Women, Business and the Law introduces two new indicators—Safety and Childcare—and presents findings on the implementation gap between laws (de jure) and how they function in practice (de facto). This study presents three indexes: (1) legal frameworks, (2) supportive frameworks (policies, institutions, services, data, budget, and access to justice), and (3) expert opinions on women’s rights in practice in the areas measured. The study’s 10 indicators—Safety, Mobility, Workplace, Pay, Marriage, Parenthood, Childcare, Entrepreneurship, Assets, and Pension—are structured around the different stages of a woman’s working life. Findings from this new research can inform policy discussions to ensure women’s full and equal participation in the economy. The indicators build evidence of the critical relationship between legal gender equality and women’s employment and entrepreneurship. Data in Women, Business and the Law 2024 are current as of October 1, 2023. wbl.worldbank.orgThis book provides a comprehensive assessment of African economic integration through the lens of International Economic Law. The analysis is…
contextualised within the prevailing regional economic integrations, the WTO and the peculiarity of the AfCFTA.Through legal analysis, bolstered by economic and political dimensions, the book illustrates the complex interplay of diverse factors that shape the AfCFTA. Each chapter presents a separate element of economic integration within the principles of international economic law, with an interdisciplinary approach encompassing legal, economic and political perspectives. Covering topics such as economic integration and multilateralism, market access, exceptions, trade facilitation, rules of origin and non-tariff barriers, the book also discusses trade remedies, dispute settlement, investment, intellectual property and completion policy. Additionally, human rights, corporate social responsibility and sustainable development principles are discussed, alongside small and medium-sized enterprises (SMEs), digital trade and gender in economic integration. The book will be of interest to students, instructors, practitioners and nonpractitioners in this area of international economic law.Healing and Cancer: A Guide to Whole Person Care
By Wayne B. Jonas, Alyssa McManamon. 2024
Healing and Cancer strives to bring the concepts of healing and whole person care further into health care delivery so that…
people with cancer feel better and live longer. This important book places the concepts, science, delivery tools, and access to further resources for whole person care into the hands of cancer care teams for use with patients and caregivers. These days, cancer care generally focuses on attacking and killing the cancer cell—a laudable goal. However, if eliminating the tumor overshadows everything else, teams can lose sight of the care and healing of the person as a whole. This has great costs: for the person there are costs in time, money, side effects, and fear; and for the care team there are costs in the joy of practice, the energy to improve practice, and in overall vitality. Often, key patient needs are inadvertently pushed to the background for lack of time, tools, and resources. Moral injury and human suffering ensue. Advances in science have now clearly demonstrated that cancer does not develop in isolation, and its occurrence, progression and regression are largely influenced by the surrounding environment—the immune system, inflammation in the body, and things we ingest and are exposed to. By utilizing the methodologies and concepts outlined in this book, oncology teams can bring the full science of cancer biology into the care of the patient while inviting the person into full engagement in their own care. Doing so, they will have achieved the highest quality of care for people diagnosed with cancer. Care teams that practice deep listening—up front and early on—to patients as people move beyond patient-centered care to person-centered and whole person care. With increasing numbers of survivors of cancer and the intensity and duration of relationships in oncology, cancer care is a field uniquely positioned to further the uptake of whole-person care and to join colleagues in primary care who are doing the same. Healing and Cancer first defines what whole person cancer care is, and drawing on examples from around the world, illustrates how and why it needs to be standard in all of oncology. The authors describe the science behind whole person care and the evidence that supports its application, including real-world examples of how it&’s being done in small clinics and large institutions, both academic and community-based. Finally, Healing and Cancer directs readers to the best tools and resources available so that cancer care teams, primary care clinicians, integrative practitioners and those with cancer can incorporate whole person care into the healing journey. Healing and Cancer is intended to be read and actively used by teams caring for people with cancer and by caregivers and patients themselves to enhance healing, health, and wellbeing.Racial Justice and the Limits of Law
By Bharat Malkani. 2024
Racial justice is never far from the headlines. The Windrush Scandal, the toppling of the statue of Edward Colston and…
racism within the police have all recently captured the public’s attention and generated legal action. But, although the ideals of the legal system such as fairness and equality, seem allied to the struggle for racial justice, all too often campaigners have been let down by the system. This book examines law’s troubled relationship with racial justice. It explains that law’s historical role in creating and perpetuating racial injustices continues to stifle its ability to advance the cause of racial justice today. Both a lawyer’s guide to anti-racism and an anti-racist’s guide to legal action, it unites these perspectives to help both groups understand how to use the law to tackle racial injustices.Belonging without Othering: How We Save Ourselves and the World
By John A. Powell, Stephen Menendian. 2024
The root of all inequality is the process of othering – and its solution is the practice of belonging We…
all yearn for connection and community, but we live in a time when calls for further division along the well-wrought lines of religion, race, ethnicity, caste, and sexuality are pervasive. This ubiquitous yet elusive problem feeds on fears – created, inherited – of the "other." While the much-touted diversity, equity, and inclusion initiatives are undeniably failing, and activists narrowly focus on specific and sometimes conflicting communities, Belonging without Othering prescribes a new approach that encourages us to turn toward one another in unprecedented and radical ways. The pressures that separate us have a common root: our tendency to cast people and groups in irreconcilable terms – or the process of "othering." This book gives vital language to this universal problem, unveiling its machinery at work across time and around the world. To subvert it, john a. powell and Stephen Menendian make a powerful and sweeping case for adopting a paradigm of belonging that does not require the creation of an "other." This new paradigm hinges on transitioning from narrow to expansive identities – even if that means challenging seemingly benevolent forms of community-building based on othering. As the threat of authoritarianism grows across the globe, this book makes the case that belonging without othering is the necessary, but not the inevitable, next step in our long journey toward creating truly equitable and thriving societies. The authors argue that we must build institutions, cultivate practices, and orient ourselves toward a shared future, not only to heal ourselves, but perhaps to save our planet as well. Brimming with clear guidance, sparkling insights, and specific examples and practices, Belonging without Othering is a future-oriented exploration that ushers us in a more hopeful direction.Other books remind us of what we already know—that privacy is under great pressure. James Rule provides a step-by-step plan…
to create a significantly more private and authentically democratic world. Taking Privacy Seriously offers both a concise, hard-hitting assessment of the origins of today’s privacy-eroding practices and a roadmap for creating robust new individual rights over our personal data. Rule proposes eleven key reforms in the control and use of personal information, all aimed at redressing the balance of power between ordinary citizens and data-hungry corporate and government institutions. What a privacy-deprived America needs most is not less technology, Rule argues, but profound political realignment. His eleven proposed reforms range from launching a major public-works investment consisting of a series of websites publicly documenting the personal data uses of nearly all government and private institutions; to instating a right for any citizen to withdraw from any personal data system not required by law; to creating a universal property right over commercial exploitation of data on oneself—so that no company or other organization could profit from use or sale of such data without permission. Succinct and compelling, Taking Privacy Seriously explains how we can refashion information technologies so that they serve human needs, not the other way around.Internal Medicine for Dental Treatments: Patients with Medical Diseases
By Toshimi Chiba, Hiroyuki Yamada. 2023
This book illustrates the precautions for dental treatment with patients with medical diseases and presents the correlation and relationship between…
oral symptoms and systemic diseases. It is organized into two parts; the first part is symptomatology presenting the description of some symptoms as general remarks. By Jong S. Kim. 2024
Psychiatric symptoms (or mood/emotional disturbances) are diverse in patients with neurological diseases, that include depression, anxiety, emotional incontinence, anger, fatigue,…
and apathy. These symptoms are common; more than 1/3 of the patients suffer from these symptoms. Unfortunately, they have been neglected because 1) unlike other neurological symptoms such as motor dysfunction, speech disturbances or visual field defect, these symptoms are not visible and difficult to be noticed unless they are specifically examined by a physician who is properly educated on this problem 2) they are often not regarded as neurological symptoms either by the patients or their caregivers 3) they are relatively poorly studied by both neurologists and psychiatrists, and accordingly, are unfamiliar to the physicians. Especially, although `depression’ is well known to physicians, other symptoms such as emotional incontinence, anger, fatigue or apathy are not appropriately assessed by physicians, and frequently misdiagnosed as depression. Moreover, there are difficulties in diagnosing depression in patients neurological diseases. For example, the individual items included in depression diagnosis such as sleep disturbances, appetite loss, or fatigue can result from neurological diseases or comorbid physical conditions in patients with neurological diseases. Therefore, a diagnosis of `depression’ should be made cautiously. Finally, it should be understood that the importance of different mood/ emotional syndromes differ among various neurological diseases; for instance, although emotional incontinence and anger occur in as many as 20-30 % of stroke patients, apathy and fatigue are more important symptoms than these for patients with neuro-degenerative disease. In clinical practice, recognizing these symptoms is important because they negatively affect the patients’ quality of life, impair the functional recovery, increase the mortality, and increase the caregiver burden. Nevertheless, unlike other neurological symptoms such as motor/sensory dysfunction, and speech disturbances, they are relatively well managed mostly by pharmacological therapy such as selective serotonin re-uptake inhibitors (SSRI).The phenomenology of these neuropsychiatric symptoms and related factors, pathophysiological mechanism, and treatment strategies should be properly educated for neurologists, psychiatrists and other physicians. The book is written by experts in this field to disseminate important knowledges to neurologists, psychiatrists, psychologists and other physicians and will eventually benefit patients with neurological diseases. An Emergency Physician’s Path: What to Expect After an Emergency Medicine Residency
By Robert P. Olympia, Elizabeth Barrall Werley, Jeffrey S. Lubin, Kahyun Yoon-Flannery. 2023
A career in emergency medicine can be truly rewarding, despite the long hours and adverse conditions. The decision to embark…
on this journey typically starts during medical school, usually with the allure of resuscitations and life-saving procedures performed in the fast-paced environment of the emergency department. During an emergency medicine residency, the young physician is faced with career decisions that may involve working in a community or academic emergency department setting, or pursuing specialization through fellowship. Following residency and fellowship training, the emergency physician may decide to purely work clinically in an emergency department, or combine clinical responsibilities with administrative, education or research pursuits. This unique text provides medical students, residents, fellows and attending physicians with a comprehensive guide to be successful in a career in emergency medicine. Sections include the history of emergencymedicine, choosing a career in emergency medicine from a medical student’s point of view, pursuing fellowship and additional training, community and academic careers in emergency medicine, career options in emergency medicine, critical skills in emergency medicine, research/scholarship, being a teacher, and carving a path in emergency medicine. All chapters are written by experts in the field, representing emergency departments throughout North America.Planning for Equitable Urban Agriculture in the United States: Future Directions for a New Ethic in City Building (Urban Agriculture)
By Samina Raja, Marcia Caton Campbell, Alexandra Judelsohn, Branden Born, Alfonso Morales. 2023
This open access book, building on the legacy of food systems scholar and advocate, Jerome Kaufman, examines the potential and…
pitfalls of planning for urban agriculture (UA) in the United States, especially in how questions of ethics and equity are addressed. The book is organized into six sections. Written by a team of scholars and practitioners, the book covers a comprehensive array of topics ranging from theory to practice of planning for equitable urban agriculture. Section 1 makes the case for re-imagining agriculture as central to urban landscapes, and unpacks why, how, and when planning should support UA, and more broadly food systems. Section 2, written by early career and seasoned scholars, provides a theoretical foundation for the book. Section 3, written by teams of scholars and community partners, examines how civic agriculture is unfolding across urban landscapes, led largely by community organizations. Section 4, written by planning practitionersand scholars, documents local government planning tied to urban agriculture, focusing especially on how they address questions of equity. Section 5 explores UA as a locus of pedagogy of equity. Section 6 places the UA movement in the US within a global context, and concludes with ideas and challenges for the future. The book concludes with a call for planning as public nurturance – an approach that can be illustrated through urban agriculture. Planning as public nurturance is a value-explicit process that centers an ethics of care, especially protecting the interests of publics that are marginalized. It builds the capacity of marginalized groups to authentically co-design and participate in planning/policy processes. Such a planning approach requires that progress toward equitable outcomes is consistently evaluated through accountability measures. And, finally, such an approach requires attention to structural and institutional inequities. Addressing these four elements is more likelyto create a condition under which urban agriculture may be used as a lever in the planning and development of more just and equitable cities.
